apply to the entire suite of Backcountry.com Corporation retail &
One Deal
at a Time (ODAT) websites which include: Backcountry.com,
BackcountryOutlet.com, DepartmentofGoods.com, Dogfunk.com,
HucknRoll.com, RealCyclist.com, SteepandCheap.com,
WhiskeyMilitia.com, Tramdock.com,
Chainlove.com, Bonktown.com & Brociety.com. In these terms and
conditions
this family of sites shall be referred to as “Backcountry.com sites.”
Brand
Representation
Publisher’s
ad copy cannot misrepresent the
relationship between the publisher and Backcountry.com sites. Copy
cannot
contain misspellings, incorrect grammar or false statements such as
“Free
Shipping on every order”, “No Tax” or “Backcountry.com Coupon” when no
coupon
has been offered. Ad copy should always represent Backcountry.com sites
in a
professional manner – basically don’t do anything that would degrade
our brand.
Publishers cannot post anything in ad copy that alludes to the fact
that we
compete on price, period. Claims such as 'authorized dealer' or
'official
store' can never be used in ad copy.
Coupon
Bidding
Backcountry.com
sites allow Publishers to bid on
the term “Backcountry.com Coupons” and variations (no straight
trademark
bidding). Within the ad copy it’s prohibited for the Publisher to claim
they
have a coupon when one hasn’t been offered.For example “Backcountry.com 30% Off Coupon” is unacceptable.Backcountry.com catalog sites do not compete
on price and only offer site-wide coupons 2-3 times per year.These are the only times it’s acceptable to
allude
in the ad copy you hold a percent off coupon. All other times
publishers must
use the current sale, promo or similar in their ad copy.For example “Winter Clearance Up To 50% Off”,
notice no mention of the word “coupon.”
Cookie
Policy
To maintain fairness between all Backcountry Corp marketing channels we
follow a strict cookie policy. All cookies regardless of channel
are subject to being trumped by the last referring URL with marketing
campaign tracking. Credit will only be given to the last
referring channel/website at the time of conversion.
Domain
Names
and URLs
Publisher
websites
must have a
unique URL (including subdomain and URL path) that does not contain
Backcountry.com
sites, trademarked brand names or any misspellings or variations of our
name or
trademarked names. Use of our vendor trademarked names or variations in
URLs is
prohibited.
Bidding
on
Pay per Click Search
Engines

Policy
General
Rule:
Publishers
may
not bid on
Backcountry.com sites, trademarks, misspellings or variation of our
brand names
through Google AdWords, Yahoo Sponsored Search or MSN ad Center.
Acceptable
Publishers
can direct
link on any keyword (including trademarks) through Content Match
(Defined as
ads placed within the content of engine network sites, exclusive of
search
results) within any search engine. Publishers can direct link on any
keyword
(including trademarks) through any Tier 2 search engine. Publishers can
bid and
direct link on any vendor brand specific keyword (including common
misspellings) that is listed for each site on the non-default list
provided by
backcountry on any Search Engine except Google.
Publisher’s
ad

Promoting
Sales
Prices
Backcountry.com
sites
may have
monthly sales. Publishers may promote our sales, but must include the
sale end
date in all advertisements. Sale information must be removed as soon as
that
sale ends.
Pop-Up,
Pop-Under,
Re-Directs and
Software
Publishers
may
not use site
re-directs, pop-ups or pop-unders that link to Backcountry.com sites.
Spam
and
Electronic Messages
Under
no
circumstances shall
Publisher send commercial electronic mail messages as defined in the
new
Federal spam law, the CAN-SPAM Act of 2003 [the “Act”], with respect to
Backcountry.com’s Affiliate Program. For clarification, this does not
prohibit
Publisher from sending transactional or relationship messages as
defined in the
Act. In addition, except as expressly authorized by Backcountry.com,
any and
all electronic messages initiated or sent by Publisher or on
Publisher’s behalf
must identify Publisher as the sender and may not suggest or imply, or
mislead
or be likely to mislead a recipient into believing that a
Backcountry.com site
is the sender or sponsor of, or has procured Publisher to send, such
electronic
messages. To be clear, Publisher may not use a return address, subject
heading,
header information or message contents that misleads or confuses or is
likely
to mislead or confuse a recipient as to Publisher being the sender.
All
publisher
electronic messages representing
Backcountry.com sites must be approved before sending.
Adult
Content
and other Unacceptable
Content
Publisher
may
not post
adult-oriented content on any page where Backcountry.com sites’ content
appears. Backcountry.com sites consider content to be "adult" if it
contains nudity or obscenity, sexually explicit, pornographic, or lewd
material. Publisher may not post any offensive content or incorporate
images or
content that is in any way harmful, threatening, obscene, harassing or
racially, ethnically or otherwise objectionable, or promote
discrimination
based on race, sex, religion, nationality, disability, sexual
orientation, or
age.
Datafeeds
Datafeeds
are
to be used only on
approved publisher websites. Publishers may not submit any of
Backcountry.com
sites’ datafeeds to any shopping portal such as Froogle or Google Base
as
stated in their terms of service.
Content
Publishers
may
not use
Backcountry.com sites’ content (including but not limited to reviews,
copy, and
images) unless it is provided in a data feed or approved by
Backcountry.com affiliate
managers. Because our content is produced entirely in-house, approved
publishers
may not utilize Backcountry.com sites’ content on any page that
promotes any
other company.
Communication
Because
we
are extremely cautious
with our brand and the brands we represent we ask that publishers
adhere
closely to these requirements. We have a long-standing reputation of
supporting
our publishers, and are here to help our publishers achieve success.
